Recognition procedure for the professions ‘Educator at an after-school care centre or special after-school care centre’ and/or ‘Nursery or special nursery worker’ – EU/EEA professional qualification – Application

  • Applications for recognition of the qualification of nursery or special nursery worker obtained in the EU or EEA can be applied for at the Office of the Provincial Government of Burgenland, specifically at Department 7 – Education, Culture and Science. In order to be employed as a nursery or special nursery worker, a positive certificate of recognition is required.

    Applications for recognition of the qualification of educator obtained in the EU or EEA can be applied for at the Office of the Provincial Government of Burgenland, specifically at Department 7 – Education, Culture and Science. In order to be employed as an educator at an after-school care centre or special after-school care centre, a positive certificate of recognition is required.

  • The following documents, accompanied by a certified translation, must be enclosed with the application: Attestations of competence and evidence of formal qualifications (issued by the competent authority in the Member State of origin), information on the total duration and the structure of the qualification obtained, content/subjects studied and the associated professional qualification obtained, level of qualification pursuant to Article 11 of Directive 2005/36/EC, proof of mastery of the German language to C1 level (language certificate or transcript), proof of citizenship, proof of name change (where applicable), proof of professional experience (where applicable).

  • There are no specific deadlines.

  • The costs must be paid at the end of the procedure and amount to an administrative charge of EUR 44.20.

  • Directive 2005/36/EC on the recognition of professional qualifications, as amended by Directive 2013/55/EU; Law on the technical employment requirements for nursery workers and educators [Gesetz über die fachlichen Anstellungserfordernisse für Kindergärtner(innen) und Erzieher(innen)]

  • Application to be submitted using the dedicated form; the aforementioned department will send a confirmation letter within 1 month of submission of the application (or remedied application, if so needed); the provincial supervisory authority will review the application and issue a decision within 4 months

  • The applicant must have completed a nursery or special nursery worker qualification in an EU/EEA Member State.

  • The procedure usually takes 4 months.

  • Decisions may be appealed against. An appeal must be submitted in writing to the decision-making authority within 4 weeks of the decision being issued. The appeal must contain the following:

    1. the name of the contested decision;
    2. the name of the authority whose decision is being appealed against (the authority that issued the decision);
    3. the grounds on which the allegation of illegality is based (statement on the scope of the challenge);
    4. what the appellant is requesting; and
    5. the information necessary to assess whether the appeal has been submitted on time. An appeal may be submitted in the following ways:
    • by post – ask the authority for the address;
    • by fax;
    • using the online form for appeals in administrative procedures,

    or on request by emailing anbringen(at)bgld.gv.at.

    Unless expressly excluded in the decision, an appeal has suspensory effect. In other words, the decision cannot be enforced until the final decision regarding the appeal has been made.
