Equal treatment (rules prohibiting discrimination in the workplace, rules on equal pay for men and women, and equal pay for employees on fixed-term or permanent employment contracts)

  • Discrimination is any form of unjustified disadvantage or unequal treatment of individuals or groups on the grounds of different perceptible characteristics (e.g. age, ethnicity or disability) or characteristics not directly perceptible (e.g. beliefs, religion or sexual orientation). Incitement to discrimination is also prohibited. The law distinguishes two types of discrimination:

    Direct discrimination – where a person is treated differently solely on the grounds of their gender, age, disability, sexual orientation, ethnic origin, beliefs or religion, although there is no objective justification for this.

    Indirect discrimination – where an apparently neutral provision treats certain persons less favourably and there is no objective justification for doing so.

    However, discrimination also exists where a neutral rule is abused on the grounds of the abovementioned characteristics in order to place individual persons or groups of people at a particular disadvantage.

    The Burgenland Provincial Equal Treatment Act and the Burgenland Anti-Discrimination Act apply to all employees who have a public-law or private-law employment relationship with the province, a municipality or an association of municipalities, apprentices of the province, municipalities or associations of municipalities, persons applying for admission to such an employment or training relationship with the province, a municipality or an association of municipalities.

    There is an equal treatment commission and an anti-discrimination commission, each of which, upon request or ex officio, issues an opinion as to whether there has been a breach of the principle of equal treatment or of the principle of the promotion of women. Each consists of five members.

    The equal treatment compliance officer of the province and the anti-discrimination compliance officer of the province and the members of the commissions are bound by the strictest duty of confidentiality in the performance of their duties.
